- If
you generate tires or tire pieces (tires listed hereafter include
tire pieces). you must:

Make sure the tires go to an approved destination. Generally
an approved destination must have provided notification or
registration, or have a permit with the TNRCC. Approved destinations
include locations that recycle, recover energy, or landfill
the tires. Others serve as temporary storage sites or reclaim
land using tires. In fact, if you can't demonstrate that your
tires went to an approved destination, you might be liable
for the clean up of a site where your tires may have been
improperly disposed. Call TNRCC if you are unsure whether
a destination is approve.
- Complete
and maintain a copy of a five part manifest for each load
shipped off site. The manifest must include the destination
of the load and signature of the generator and transporter,
Within 60 days. the generator must also receive a final manifest
copy back from a resentative of the approved destination.
- Keep
your original manifests, work orders, invoices and other documentation
used to support activities related to the accumulation, handling,
and shipment of used or scrap tires for three years.
- Use
a TNRCC registered scrap tire transporter if you have someone
haul your tires for disposal.

You may self haul scrap tires or tire pieces you generate between
your own business locations and approved destinations without
a transporter registration. You must, however comply with manifest
requirements.
- If
you store more than 500 used or scrap tires, you must obtain a
generator registration number. in addition, if you store more
than 500 used or scrap tires on the ground or 2,000 in trailers
(or weight equivalent of tire pieces), you must obtain a scrap
tire storage registration from TNRCC.
- If
you sell good used tires as a commodity, you must keep such tires
sorted, marked, classified. and arranged in an organized manner
for sale to the consumer. If not, the tires are considered stockpiled
scrap tires, and you will be subject to registration requirements.

Tires stored outside must be monitored for vectors (disease transmitters
like mosquitos) and appropriate vector control measures must be
utilized at least once every two weeks.

or scrap tire rules are located in Title 30 of the Texas Administrative
Code, Chapter 328 Subchapter F. These rules, a manifest form,
a registration form and a listing of approved destinations can
be accessed from TNRCC's web site at http://www.tnrcc.state.tx.us.
